1. Our role under data protection law

In those circumstances, the customer organisation normally determines why that information is being processed and is the data controller. JobCue processes the information on the customer’s behalf and is normally the data processor.
For example, a JobCue customer might use its workspace to store:

- project notes and communications;
- staff or User information;
- freelancer information;
- supplier information;
- timesheets;
- tasks and To Do items;

- approvals and comments;
- uploaded documents and attachments;
- audit and activity records.
The customer organisation is responsible for ensuring that it has an appropriate lawful basis for entering and using this personal data within JobCue.
If you wish to exercise your rights in relation to information held about you by a JobCue customer, you should normally contact that customer organisation first. We will provide reasonable assistance to JobCue customers in responding to valid data-protection requests where required.
2. Personal information we collect
The information we collect depends on how you interact with JobCue.

3. Information stored within a customer’s JobCue workspace
JobCue is a modular business-management platform. The precise information stored within an organisation’s account therefore depends on which features and modules that organisation uses and what information it chooses to enter.
Customer-controlled information may include information within areas such as:
- User Management;
- Timesheets;
- CRM & Sales;
- Job Management;
- Project Management;
- Client Portal;
- Content Map & Approvals;
- To Do;
- Resource Planning;
- Equipment Inventory;
- Freelancers;
- Renewals & Recurring Services;
- Accounts & Bookkeeping;
- Support;
- Briefing;
- organisation settings and templates.
A JobCue customer determines what information it enters and who within its organisation is authorised to access it.
JobCue does not require customers to enter personal information that is unnecessary for the service they are providing.
Customers should not enter special-category personal data or other particularly sensitive information unless they have determined that doing so is necessary, lawful and appropriate for their use of JobCue.
4. Files and document storage
JobCue may allow customers to upload or associate files and documents with records in their workspace.
Depending on the organisation’s storage configuration, files may be stored using storage provided as part of JobCue or through a supported third-party storage service selected by the customer.
Where a customer configures supported external storage, such as its own Microsoft 365/OneDrive or Dropbox environment, the files may be stored directly within that external service.
JobCue may still retain information required to connect the external file to the relevant JobCue record, such as:
- file name;
- file description;
- storage-provider identifier;
- folder or object reference;
- audit information;
- lifecycle or archive status;
- information required to display or retrieve the file through JobCue.
The external storage provider’s own privacy and data-protection arrangements will also apply to information stored using that provider.
Customers are responsible for selecting and configuring an appropriate external storage provider and controlling access to their own storage environment.
5. How we use personal information
Where JobCue acts as a data controller, we may use personal information to:
Provide JobCue
This includes:
- registering organisations and Users;
- creating and administering accounts;
- providing trials;
- enabling selected modules;
- providing authentication and account access;
- operating subscriptions;
- providing customer support.
Process subscriptions and payments
We use relevant information to:
- calculate subscription charges;
- issue and administer invoices;
- collect or reconcile payments;
- manage subscription changes;
- handle failed payments;
- administer referral discounts and reseller commissions;
- maintain accounting and financial records.

JobCue remains responsible for using appropriate providers and putting appropriate contractual arrangements in place.
Where a customer independently chooses to connect its own Microsoft, Dropbox or other supported service to JobCue, that provider may also have a direct contractual and data-protection relationship with the customer.
Our processing of customer-controlled personal data is also governed by the applicable JobCue Data Processing Agreement.
11. International transfers
Some organisations that provide technology or support services to JobCue may operate internationally or process information outside the United Kingdom.
Where personal information is transferred internationally, we will take appropriate steps required by applicable data-protection law.
Depending on the destination and provider, these steps may include:
- reliance on UK adequacy regulations;
- use of recognised contractual safeguards;
- the UK International Data Transfer Agreement;
- an appropriate UK Addendum to recognised contractual clauses;
- another lawful transfer mechanism.
Customers using external storage or connected services should also review the international-transfer arrangements of the providers they choose to use.
12. How long we keep personal information
We do not aim to keep personal information for longer than is reasonably necessary.
Retention periods depend on the type of information, why it was collected and whether there is a legal, contractual, accounting, security or dispute-related reason for retaining it.
Website and enquiry information
Enquiry and correspondence records may be retained for as long as reasonably necessary to deal with the enquiry, maintain an appropriate business record and manage any subsequent commercial relationship.
Information that is no longer required will be deleted or anonymised where appropriate.
Customer and User account information
Account information is normally retained while the relevant JobCue account remains active.
Following cancellation or termination, some account information may be retained for a reasonable period for purposes including:

- any deletion or archiving functionality available within JobCue;
- legal or technical requirements applying to the service.
Following termination of an account, customer-controlled information may be deleted in accordance with the applicable contractual and technical retention process, subject to any lawful requirement to retain particular records.
Backups may continue to contain deleted information for a limited period until they are overwritten through the normal backup cycle.
13. Data stored by JobCue customers
JobCue customers may use the platform to manage information about third parties with whom JobCue itself has no direct relationship.
For example, a customer may enter details relating to one of its:
- employees;
- freelancers;
- clients;
- prospective clients;
- suppliers;
- contractors;
- client contacts;
- project stakeholders.
In these circumstances, JobCue does not decide why the customer has collected the information.
If you believe information about you is held within a particular organisation’s JobCue workspace, you should normally contact that organisation directly.
Where appropriate, JobCue will assist the customer in fulfilling its data-protection obligations.
14. Your data-protection rights
Depending on the circumstances and the lawful basis being used, UK data-protection law may give you rights including:
Right of access
You may ask us for confirmation of whether we process your personal data and request a copy of personal data we hold about you.
Right to rectification
You may ask us to correct information that is inaccurate or complete information that is incomplete.
Right to erasure
In certain circumstances, you may ask us to delete your personal data.
This right does not apply where we are legally entitled or required to retain the information.
Right to restriction
In certain circumstances, you may ask us to restrict how your personal information is used.
Right to data portability
